Terms of Service

1. Acceptance of Terms

Welcome to Huxley. By accessing or using our website, application, or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. VizCreator LLC, a Delaware limited liability company (“we,” “us,” or “our”), reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

Huxley is a community-funded independent product testing platform. The Service enables consumers to crowdfund laboratory tests on everyday grocery products — including tests for heavy metals, pesticides, PFAS, microplastics, mycotoxins, and nutritional accuracy — identified by UPC barcode. The Service includes features such as product browsing, testing campaign creation, pledge-based crowdfunding, subscription access to detailed lab results, and downloadable PDF reports. Lab testing is performed by independent, accredited third-party laboratories.

3. Account Registration

To use certain features of the Service, you must create an account by providing a valid email address and password, or by signing in with a supported third-party authentication provider. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Subscriptions and Payment

Huxley offers a monthly subscription plan that provides full access to detailed lab results and downloadable PDF reports for all tested products. By subscribing, you agree to the following:

  • Subscription Fee: Access to premium features requires an active paid subscription at the current rate displayed on our website (currently $3/month).
  • Billing: Subscriptions are billed monthly in advance. You authorize us to charge your payment method on a recurring basis.
  • Payment Processing: Payments are processed through Stripe, a third-party payment processor. You agree to Stripe's terms of service.
  • Price Changes: We reserve the right to modify subscription fees with at least 30 days' notice.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Pledges and Crowdfunding

Huxley allows users to pledge funds toward testing campaigns for specific products. By making a pledge, you agree to the following:

  • Payment Hold: When you pledge, a hold is placed on your payment method for the pledged amount. You will not be charged until the campaign reaches its funding goal.
  • Successful Campaigns: If a campaign reaches its funding goal, your payment will be captured and the funds used to purchase lab testing. You will receive full access to the detailed results for the panel(s) you funded, regardless of subscription status.
  • Expired Campaigns: If a campaign does not reach its funding goal by its expiration date, your payment hold is automatically released and you will not be charged.
  • No Guaranteed Timeline: While we strive to complete testing promptly, lab testing timelines depend on third-party laboratories and are not guaranteed.

6. Refund Policy

Subscription fees are non-refundable. No refunds or credits will be provided for partial subscription periods or unused portions of the Service.

Once a campaign is funded and your payment has been captured, no refunds are available. The funds are used to purchase lab testing, which cannot be reversed once initiated.

In the rare event that lab testing cannot be completed (e.g., the item cannot be tested or is unavailable), all pledgers on the affected campaign will receive a full refund to their original payment method.

7. Credits

Huxley may issue credits to your account as promotional rewards or bonuses. Credits can be applied toward pledge amounts to reduce or eliminate the card payment required. By accepting credits, you agree to the following:

  • Credits have no cash value and cannot be redeemed for cash or transferred to another user.
  • Credits do not expire while your account is active.
  • If your account is deleted, any remaining credits are forfeited.

8. Lab Results Disclaimer

LAB RESULTS PROVIDED THROUGH THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL, HEALTH, SAFETY, OR NUTRITIONAL ADVICE.

While we partner with accredited, independent laboratories, we do not guarantee the accuracy, completeness, or reliability of any lab results. Results reflect testing of specific product samples at a specific point in time and may not be representative of all units, batches, or future production runs of the same product.

You should not rely solely on information provided through the Service to make health, dietary, or purchasing decisions. Always consult with a qualified healthcare professional regarding health concerns.

9. Intellectual Property

The Service, including all content, features, functionality, software, designs, graphics, and trademarks, is owned by VizCreator LLC or its licensors and is protected by United States and international copyright, trademark, patent, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited license to access and use the Service in accordance with these Terms.

10. Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Modify, adapt, translate, or create derivative works of the Service
  • Scrape, crawl, or use automated means to access or collect data from the Service without our prior written consent
  • Use the Service for any illegal, unauthorized, or otherwise improper purposes
  • Circumvent or attempt to circumvent any security features or access controls
  • Use the Service to harm, harass, or violate the rights of others
  • Share your account credentials with others
  • Misrepresent lab results or use results obtained through the Service to make false or misleading claims about products

11. Data and Privacy

Your privacy is important to us. We collect account information, payment information (processed by Stripe), usage analytics, and device information as described in our Privacy Policy. By using the Service, you consent to our collection and use of data as described in our Privacy Policy.

12. Third-Party Services

The Service integrates with third-party services including Supabase (authentication and database), Stripe (payment processing), and independent laboratories (testing). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or performance of third-party services.

13. Updates and Modifications

We may update, modify, or discontinue the Service or any features thereof at any time with or without notice. We are not liable for any modifications, suspensions, or discontinuations of the Service.

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms or failure to pay applicable fees. You may terminate your account at any time by canceling your subscription through the Service. Upon termination, your right to use the Service immediately ceases. Termination does not entitle you to any refund of fees paid.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF LAB RESULTS OR ANY CONTENT PROVIDED THROUGH THE SERVICE. YOU USE THE SERVICE AT YOUR OWN RISK.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIZCREATOR LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

17. Indemnification

You agree to indemnify, defend, and hold harmless VizCreator LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

18. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

19. International Use

The Service is controlled and operated from the United States. We make no representations that the Service is appropriate or available for use outside the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

20. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and VizCreator LLC regarding the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

1. Introduction

VizCreator LLC (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Huxley, our community-funded independent product testing platform (the “Service”). Please read this Privacy Policy carefully. By using the Service, you consent to the practices described in this Privacy Policy.

2. Information We Collect

We collect the following types of information:

2.1 Personal Information

  • Account Information: When you create an account, we collect your email address and password (or OAuth credentials if you sign in with a supported third-party provider such as Google).
  • Profile Information: You may optionally provide a display name and profile photo.
  • Payment Information: Payment details (credit card information) are processed and stored by our third-party payment processor, Stripe. We do not store your full payment card details on our servers.

2.2 Usage and Activity Data

  • Product Interactions: We collect information about products you view, save, and search for in order to provide features like recently viewed and saved products.
  • Campaign and Pledge Activity: We record your pledge history, campaign initiations, and subscription status.
  • Contact Submissions: If you submit a report or contact form, we store the content of your submission along with your user ID (if logged in).

2.3 Technical Information

  • Device Information: We collect information about your device, including browser type, operating system, and screen resolution.
  • Usage Analytics: We collect analytics and usage statistics such as pages visited, features used, and session duration to improve the Service.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, operate, and maintain the Service
  • To manage your account and authenticate your access
  • To process payments, manage subscriptions, and handle pledge transactions
  • To display your recently viewed products, saved products, and pledge history
  • To send you important service notifications, updates, and administrative messages
  • To analyze usage patterns and improve the Service's features, performance, and user experience
  • To troubleshoot technical issues and provide customer support
  • To detect, prevent, and address fraud, security issues, and technical problems
  • To comply with legal obligations and enforce our Terms of Service

4. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties. We may share your information only in the following limited circumstances:

4.1 Service Providers

We share information with trusted third-party service providers who assist us in operating the Service:

  • Supabase: Authentication services and database hosting for account management and data storage
  • Stripe: Payment processing and subscription management
  • Cloudflare: Website hosting, content delivery, and image storage

These service providers are contractually obligated to protect your information and use it only for the purposes for which we disclose it to them.

4.2 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency), or to protect our rights, property, or safety, or the rights, property, or safety of others.

4.3 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

5. Data Storage and Security

We take reasonable measures to protect your information from unauthorized access, disclosure, alteration, and destruction. Your data is stored on secure servers provided by Supabase and Cloudflare, both of which employ industry-standard security practices. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

6. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information:

  • Access: You can request access to the personal information we hold about you
  • Correction: You can request that we correct inaccurate or incomplete information
  • Deletion: You can request that we delete your personal information, subject to certain legal exceptions. You can also delete your account through the Settings page.
  • Portability: You can request a copy of your personal information in a structured, machine-readable format
  • Objection: You can object to certain processing of your personal information

7. Data Retention

We retain your personal information for as long as necessary to provide the Service and fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When you delete your account, we will delete or anonymize your personal information within a reasonable timeframe, except where we are required to retain it for legal, regulatory, or legitimate business purposes.

8. Children's Privacy

The Service is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete such information as soon as possible. If you believe we have collected information from a child under 13, please contact us immediately.

9. International Data Transfers

Your information may be transferred to and processed in the United States or other countries where our service providers operate. These countries may have data protection laws that differ from those in your country. By using the Service, you consent to the transfer of your information to countries outside your country of residence, including the United States.

The Service may contain links to third-party websites or services that are not owned or controlled by us, including links to product manufacturers and retailers. We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the updated Privacy Policy on our website and updating the “Last Updated” date. 12. California Privacy Rights (CCPA)

  • Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Opt-Out: You have the right to opt out of the sale of your personal information. We do not sell your personal information.
  • Right to Non-Discrimination: You have the right not to be discriminated against for exercising any of your CCPA rights.

About Huxley

The problem

Most grocery brands don't publish test results for things like heavy metals, pesticides or PFAS in their products. That data mostly doesn't exist publicly. When independent testing does happen, the results are scattered. Some come from apps that scrape and aggregate data already published elsewhere. Some come from one-off tests run by individuals and dropped into a database with no context on methodology or sourcing. The coverage is sporadic. You might find a batch of results for products you've never heard of but nothing for the ones you actually buy.

And you have no say in any of it. You can't request a test. You can't choose the product. You just wait and hope someone eventually gets around to testing the things you care about.

What Huxley does

Huxley gives you a direct line to the same accredited laboratories that major food companies and government agencies use, except you're the one in charge. You choose the product. You choose the panel: heavy metals, pesticides, PFAS, nutritional accuracy, whatever matters to you. Then you and other consumers pool your money to fund the test. The lab buys three samples from three different stores, runs the analysis and publishes every result. Pass or fail, no exceptions.

Why it exists

Huxley started because I wanted these results for myself. As a parent and a consumer paying attention to what's in everyday products, the heavy metals in baby food, the PFAS in packaging, the gap between what's on the label and what's actually inside, I couldn't find a service that let me test the specific products I buy. The existing options are either focused on supplements, funded by the brands they review, relying on aggregated secondhand data or priced out of reach. So I built Huxley to fill that gap.

The bigger idea

I believe that when consumers are in charge of what gets tested, we move faster than any single organization could. Instead of waiting for someone to decide your favorite chocolate bar is worth testing, you can fund it yourself and have results in weeks. When enough people care about the same product, the cost per person drops to a few dollars. And when results get outdated, the community can fund a retest. You want this product tested and you want it now. That's it. That's how it should work.

The long-term goal is to drive testing costs down as far as possible through lab partnerships and volume and to put money back into the community wherever we can. The credit system is a first step. Campaign starters earn credits when their campaigns succeed. As Huxley grows I want to find more ways to return value to the people who make the platform work. This isn't something I'm trying to get rich from. I want these results to exist and I think you do too.

How it works

  • Find a product by name or barcode
  • Fund a test by pledging as little as $1 toward any testing panel. You're not charged unless the campaign reaches its goal.
  • Lab testing begins when the campaign is funded. ISO 17025 accredited labs purchase 3 samples from different stores and run the analysis. No cherry-picking.
  • Results published with substance-by-substance breakdowns compared against EPA and FDA tolerance levels. Every result made available, pass or fail.

Pricing

Free users get access to a selection of free results as a preview of the platform plus full results for any panels they personally helped fund. A $3/month subscription unlocks full detailed results and downloadable PDF reports for everything on the platform. We intentionally keep the subscription price low. The goal is access, not exclusivity.
